$300,000.00 Settlement in a tragic but academically interesting case in which a tree from property adjoining the road on which my client was travelling fell during a rainstorm crushing the cab of his truck, fracturing his neck and severing his spinal cord. While the Virginia Supreme Court’s 2012 holding in Cline v. Dunlora South, LLC, which drastically limited the liability of property owners whose trees fall and cause personal injury, made a favorable result dubious, I was able to show that the property owner had previously had work done to the same tree and that he had made the condition of the tree more dangerous than it would have been in the state of nature and more likely to fall. The case settled before trial for the homeowner’s policy limits.
